Are Edibles Illegal?
Before we start our trek across the U.S. to take a look at individual state cannabis laws, let’s take care of a little housekeeping.
Many states permit the use or possession of marijuana under state law, even though it remains illegal under federal law. So, while you might be permitted by the state you’re in to use cannabis, there is always the potential for some federal enforcement (with increased likelihood in spaces operating under federal jurisdiction, such as airports). Federal law does, however, allow the use of hemp products — those cannabis plants with less than 0.3% THC — making hemp an exception (read more about hemp-derived THC here), even in states where marijuana is banned. That said, some states still prohibit or restrict the use of hemp under state law.
This means that while THC products can be legal in one state (under state law, at least), they can be partially legal in some, or even completely illegal in others. That major caveat out of the way, if you find yourself in a state where THC — whether hemp-derived or marijuana-derived — is plain old legal under state law, then edible products like gummies, beverages, and snacks are generally legal at the state level as well.

It’s time to make our trip across the country, going state-by-state to check out current cannabis state laws (as of July 2025). For each state, we’ll look at three different statuses:

It’s important to note that we’re specifically looking at delta-9 THC when talking about hemp-derived THC in this article. That means other forms of THC (i.e., delta-8, delta-10, THC-0, etc.) may still be restricted or banned in states where hemp-derived delta-9 THC is fully legal. It’s a detail you don’t really need to worry about here, but it’s worth mentioning.
